01

Who we are and what this policy covers

Techcrest Marketing Ltd. (“Techcrest,” “we,” “us,” or “our”) is a digital marketing and website services business based in Morden, Manitoba, Canada. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information through our website, enquiries, marketing activities, and client relationships.

This Policy is intended to describe our practices under applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) where it applies. It should be read together with our Terms & Conditions and Disclaimer.

02

What personal information we may collect

Depending on how you interact with us, we may collect information such as your name, business name, job title, email address, phone number, mailing or business address, project details, budget or service interests, messages, files or information you submit through forms, and records of communications with us.

When you use our website, we may also receive technical information such as IP address, browser type, device information, operating system, referring pages, approximate location derived from IP, pages viewed, interaction events, timestamps, cookie identifiers, and similar analytics or security information.

For clients, we may also process account credentials, access permissions, billing and transaction records, website or platform data, content, campaign information, analytics data, and other information reasonably required to deliver the agreed services.

03

How we collect information

We may collect personal information directly from you when you contact us, request a quote, submit a form, subscribe to communications, become a client, provide project materials, communicate by email or phone, or otherwise interact with Techcrest.

We may also collect information automatically through cookies, pixels, analytics tools, server logs, and similar technologies, and may receive information from third-party platforms or service providers where you have authorised access or where permitted by law.

04

Why we use personal information

We may use personal information to respond to enquiries; prepare proposals and estimates; provide, manage, support, and improve our services; communicate about projects; administer accounts and billing; operate and secure our website; understand website use; measure marketing performance; improve user experience; prevent fraud or misuse; maintain business records; comply with legal obligations; and establish, exercise, or defend legal rights.

Where permitted by law and, where required, with consent, we may also use contact information to send relevant updates, educational content, service information, or marketing communications.

05

Consent and your choices

We seek consent in a form appropriate to the sensitivity of the information and the context of collection. Consent may be express or implied where permitted by law. When information is collected for a new purpose that is not reasonably connected to the original purpose, we will seek additional consent where required.

You may withdraw consent to certain uses of personal information, subject to legal, contractual, security, or operational restrictions and reasonable notice. Withdrawing consent may affect our ability to provide a service that depends on the information.

06

Website forms, enquiries, and client communications

Information submitted through contact forms, quote forms, email, phone, or other communication channels is used to respond to your request and manage the resulting business relationship. Our website currently uses Fluent Forms and FluentCRM technologies for certain form and contact-management functions.

Form submissions and communications may be stored within our website, CRM, email, hosting, backup, or related service infrastructure. We limit access to those who reasonably require it for business purposes.

07

Cookies and similar technologies

Our website may use cookies and similar technologies to operate the site, remember preferences, support security, understand traffic, measure interactions, and support marketing. Cookies may be set by Techcrest or by third-party providers whose tools are used on the website.

You can usually control or delete cookies through your browser settings. Blocking some cookies may affect website functionality. Where applicable, we may also provide consent controls for non-essential analytics or marketing technologies.

08

Analytics and measurement

We use Google technologies, including Google Analytics through Site Kit, to understand how visitors use the website and to measure site performance. These services may receive information such as device identifiers, IP-related information, browser details, pages viewed, and interaction events, subject to the provider’s own terms and privacy practices.

Analytics information is used in aggregate where practical to improve content, website structure, usability, and marketing decisions.

09

Advertising and Meta Pixel

Our website uses Meta Pixel technology. Meta may receive information about visits and interactions with our website and may use that information in accordance with its own terms and privacy practices, including for measurement, attribution, audience development, and advertising services.

Where required by law, we rely on appropriate consent before using non-essential advertising or tracking technologies. Your browser, device, or the relevant platform may also provide privacy and advertising controls.

10

Email marketing and commercial messages

If you subscribe to marketing communications or otherwise provide consent to receive commercial electronic messages, we may use your contact information to send service updates, resources, or promotional communications. We seek to comply with Canada’s Anti-Spam Legislation (CASL) where it applies.

Marketing emails will include a way to unsubscribe. You may also ask us to stop sending marketing communications by contacting us. Transactional, project, security, billing, or service-related communications may still be sent where necessary.

11

Service providers and third parties

We may use trusted service providers to support website hosting, email delivery, form processing, CRM functions, analytics, advertising, backups, security, software, file storage, project management, payment processing, and other business operations. These providers may process personal information on our behalf or as independent organisations under their own privacy terms.

We disclose only the information reasonably necessary for the relevant service and expect service providers handling personal information on our behalf to use appropriate safeguards.

12

Cross-border processing

Some of our service providers may store or process information outside Manitoba or outside Canada, including in the United States or other jurisdictions. When information is processed in another jurisdiction, it may be subject to the laws and lawful access requirements of that jurisdiction.

We use reasonable contractual, technical, and organisational measures appropriate to the circumstances when working with service providers that handle personal information.

13

When we may disclose personal information

We may disclose personal information to service providers and contractors who assist us; to professional advisers such as lawyers or accountants; where you direct or consent to the disclosure; where required or permitted by law; to investigate fraud, security incidents, misuse, or threats; to protect our legal rights, property, clients, personnel, or others; or in connection with a proposed or completed business transaction such as a merger, financing, reorganisation, sale, or transfer of assets.

We do not sell personal information as a data-broker business model.

14

Client project data

When Techcrest works on a client website, advertising account, analytics property, CRM, eCommerce store, or other digital system, we may access personal information controlled by the client. In those situations, the client remains responsible for determining the lawful basis, notices, consents, retention rules, and other privacy requirements applicable to its own customers, users, and business data unless a written agreement expressly assigns a responsibility to Techcrest.

We use client project data only as reasonably necessary to provide the agreed services, maintain security, meet legal obligations, or as otherwise instructed or authorised.

15

Retention of personal information

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, to provide services, maintain appropriate business and financial records, comply with legal or contractual obligations, resolve disputes, enforce agreements, prevent fraud, and maintain security.

Retention periods vary by type of information and context. When information is no longer reasonably required, we may delete, anonymise, or securely dispose of it, subject to backup cycles and lawful record-keeping requirements.

16

How we protect information

We use reasonable administrative, technical, and organisational safeguards appropriate to the sensitivity of the information and the nature of our business. These may include access controls, password and account-management practices, software updates, backups, security tools, restricted access, and service-provider safeguards.

No internet transmission, website, server, cloud service, or storage system can be guaranteed completely secure. If you believe information associated with Techcrest has been compromised, please contact us promptly.

17

Privacy incidents and breaches

We maintain procedures for responding to suspected privacy or security incidents. Where required by applicable law, we will assess the incident, take reasonable steps to contain and remediate it, and provide notices or reports to affected individuals or regulators when the applicable legal threshold is met.

18

Your access, correction, and privacy requests

Subject to applicable law and permitted exceptions, you may request access to personal information we hold about you and ask that inaccurate or incomplete information be corrected. You may also ask questions about our privacy practices, withdraw consent where applicable, or request deletion of information where we are not required or permitted to retain it.

We may need to verify your identity before responding to a privacy request. Some requests may be limited by legal, security, privilege, contractual, or record-retention requirements. We will explain a refusal or limitation where required by law.

19

Children and minors

Our website and services are intended for businesses and general adult audiences and are not directed to children. We do not knowingly seek to collect personal information from children for marketing purposes. If you believe a child has provided personal information to us without appropriate consent, please contact us so we can review the matter.

20

External websites and embedded services

Our website may link to third-party websites or use embedded content and services. Those third parties have their own privacy practices, policies, and terms. Techcrest is not responsible for how an independent third party collects or uses personal information once you interact directly with that service.

21

Business transfers

If Techcrest is involved in a merger, acquisition, financing, corporate reorganisation, sale of assets, or similar transaction, personal information may be disclosed to advisers, potential counterparties, or successors as permitted by law and subject to appropriate confidentiality or other safeguards.

22

Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our services, technologies, vendors, legal requirements, or business practices. The “Last updated” date at the top of this page identifies the most recent revision.

Where a change materially affects how we handle personal information, we may take additional steps to provide notice where appropriate or required by law.
